HUD Rule Affecting Mixed-Status Families
The Department of Housing and Urban Development (HUD) issued a notice of proposed rulemaking that would prohibit families with any individuals who are not in eligible immigration status from living in public housing and Section 8 programs. Currently, families with ineligible members receive prorated housing subsidies so that the whole family still has access to subsidized housing.
The proposed rule would alter this practice and require all non-elderly residents to have their immigration status verified. Families with members who are deemed “ineligible” will be evicted from subsidized housing within 18 months.
