Resources for Preserving Assisted Housing

To assist affordable housing advocates and preservation developers, the Compact developed the map and resources below as tools to encourage owners to renew their contracts, or find responsible preservation developers to buy the properties.

State and Local Preservation Laws

The Compact convenes the Interagency Council, a venue for public agencies, along with tenant advocates, to come together to develop creative strategies to preserve at-risk government assisted rental housing.

The State of Illinois and the City of Chicago have laws in place to preserve federally assisted housing that is at risk of losing use restrictions that keep units affordable.

The Compact created summaries of both laws and a timeline of how these laws interact with HUD processes.

These tools can help affordable housing advocates and government staff ensure owners follow the necessary procedures regarding opt-outs.

Top Reasons Owners Should Renew Project Based Section 8 Contracts

The following list can be used as talking points for affordable housing advocates, government staff, and others when talking to owners about preserving affordability.

Contract Simplicity

One HUD contract vs. hundreds of contracts with the housing authority

Avoid Displacing Residents

Allowing vulnerable residents to stay in place strengthens an owner’s public image

Less Turnover

Generally, tenants stay in units longer when they are covered by a project-based contract

Project-based contracts provide guaranteed rents

Easier to Underwrite a Contract

Generally, lenders find it more difficult to underwrite housing choice vouchers than a project-based contract

Opting out triggers compliance with the State & City of Chicago

– Compliance requires extensive data submissions,
– Noncompliance results in monetary fines and potential civil action, and
– Noncompliance with the state and local laws will result in noncompliance with HUD
